This Site provides information and access to construction and contracting services within British Columbia.

If you enter into a separate written or digital Construction Agreement or Service Contract with LH Bros LLC (DBA – East Peak Contracting), that agreement will govern your specific project and will prevail in the event of any conflict or inconsistency with these Terms and Conditions. These Terms and Conditions apply in addition to, and not in substitution of, the terms set out in any such agreement.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on our Site is the property of LH Bros LLC (DBA – East Peak Contracting) and its creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and all other materials that contribute to the composition of our Site.

You are granted a limited, non-exclusive, and revocable license to access and use the Site and its content for informational purposes. You may not reproduce, distribute, modify, or otherwise use any content from this Site without our express written permission.

Age Restrictions

Design coordination and consultation

All project pricing, deliverables, and timelines will be detailed in a written estimate or contract. Verbal agreements are not binding. Estimates provided through the Site are for reference only and do not constitute an offer until formally accepted by both parties.

Payments

Payment terms are defined in each Construction Agreement. Unless otherwise stated:

A deposit is required before work begins.

Progress payments may be invoiced at specified project milestones.

The final balance is due upon substantial completion of work.

All deposits and progress payments are non-refundable, as they secure materials, labour, and scheduling resources. Late payments may result in interest charges and suspension of work.

Refunds

Refunds are not typically available once services have been rendered or materials ordered.
In cases of project cancellation, reconciliation will occur in accordance with the Construction Agreement and applicable law.

If applicable, refunds will comply with the Business Practices and Consumer Protection Act (BPCPA) and any other relevant BC consumer protection legislation.

Permits and Regulatory Compliance

East Peak Contracting complies with all applicable British Columbia Building Codes, municipal bylaws, and WorkSafeBC regulations.

The Company will obtain necessary permits and approvals where required by contract. The client is responsible for ensuring site access and adherence to strata or homeowner association rules.

Builders Lien Act Notice

Under the Builders Lien Act (British Columbia), the Company and its subcontractors may have the right to file a lien on the property for unpaid work or materials. Clients are encouraged to familiarize themselves with their rights and obligations under the Act.

The Company reserves the right to register a lien for non-payment and to pursue remedies under provincial law.

Warranties

East Peak Contracting provides a limited workmanship warranty of [insert duration, e.g., 1 year] from the date of substantial completion.
Manufacturer warranties apply to materials as provided by their suppliers.

This warranty does not cover:

Damage due to misuse, neglect, acts of nature, or alterations by others

Normal wear and tear

Issues arising from materials or components supplied by the client

All warranty work will comply with BC’s Homeowner Protection Act and applicable construction standards.

Project Scheduling and Delays

Project timelines are estimates only. The Company is not liable for delays caused by weather, permitting, material shortages, labour disputes, or other factors beyond its control.

Reasonable efforts will be made to keep the client informed and minimize disruption.

Site Access and Safety

Clients must provide safe and reasonable access to the worksite.
Work areas must remain free of obstructions, pets, or unauthorized persons during construction.

The Company maintains full compliance with WorkSafeBC and all occupational health and safety requirements.

Limitation of Liability

To the fullest extent permitted by law, LH Bros LLC (DBA – East Peak Contracting) and its directors, officers, employees, agents, and affiliates shall not be liable for indirect, incidental, or consequential damages arising from:

Use of the Site

Any project delays or unforeseen site conditions

Reliance on third-party suppliers or subcontractors

The Company’s total liability for any claim shall not exceed the amount paid for the portion of work giving rise to the claim.

Indemnity

Except where prohibited by law, by using this Site you agree to indemnify and hold harmless LH Bros LLC (DBA – East Peak Contracting) and its representatives from any claims, damages, or expenses (including legal fees) resulting from your use of the Site or breach of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

Dispute Resolution

If you and LH Bros LLC (DBA – East Peak Contracting) are unable to resolve a dispute through informal discussion, both parties agree to submit the matter to non-binding mediation in British Columbia first, followed by binding arbitration if mediation fails.

The decision of the arbitrator will be final and binding. The costs of mediation or arbitration will be borne by the unsuccessful party.

Notwithstanding this clause, both parties retain the right to pursue matters in Small Claims Court or seek injunctive relief in cases of non-payment or intellectual property infringement.

Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be removed, and the remaining provisions will continue in full force and effect.

Changes

These Terms and Conditions may be updated periodically to maintain compliance with British Columbia law and industry standards. Notice of material changes will be posted on our Site or sent via email.
