Payments
Each Construction Agreement defines payment terms. Standard arrangements include:

as they secure materials, labour, and scheduling. Late payments may incur interest and work suspension.
Refunds
Services rendered or ordered materials typically don't qualify for refunds. Project cancellations involve reconciliation per the Construction Agreement and applicable law. Refunds comply with the Business Practices and Consumer Protection Act (BPCPA) and relevant BC consumer protection legislation.
Permits and Regulatory Compliance
The company follows British Columbia Building Codes, municipal bylaws, and WorkSafeBC regulations. Required permits are obtained per contract. Clients ensure site access and strata/association rule compliance.
Builders Lien Act Notice
Under British Columbia's Builders Lien Act, the company and subcontractors may file liens for unpaid work or materials. The company reserves lien registration rights and pursuit of provincial law remedies.
Warranties
A limited workmanship warranty applies from substantial completion (duration to be specified). Manufacturer warranties cover supplied materials. The warranty excludes:
- Damage from misuse, neglect, acts of nature, or third-party alterations
- Normal wear and tear
- Issues from client-supplied materials or components
Warranty work complies with BC's Homeowner Protection Act and construction standards.
Project Scheduling and Delays
Timelines are estimates only. The company isn't liable for delays from weather, permitting, material shortages, labour disputes, or uncontrollable factors. Reasonable efforts maintain client communication and minimize disruption.
Site Access and Safety
Clients provide safe, reasonable worksite access. Work areas must remain clear of obstructions, pets, and unauthorized persons. The company maintains full WorkSafeBC and occupational health and safety compliance.
Limitation of Liability
East Peak Contracting and its representatives aren't liable for indirect, incidental, or consequential damages from site use, project delays, unforeseen site conditions, or third-party reliance. Total liability doesn't exceed amounts paid for the work in question.
Indemnity
Users indemnify and hold harmless the company from claims, damages, or expenses (including legal fees) from site use or term violations, except where prohibited by law.
Applicable Law
British Columbia and applicable federal Canadian law govern these terms.
Dispute Resolution
Unresolved disputes proceed through

if mediation fails. The arbitrator's decision is final and binding. The unsuccessful party bears mediation or arbitration costs. Both parties retain rights to pursue Small Claims Court matters or seek injunctive relief for non-payment or intellectual property infringement.
Severability
Invalid or unenforceable provisions are removed while remaining provisions continue in full effect.
Changes
